EXERCISING THE RIGHT OF WITHDRAWAL:
Pursuant to Article 59 of Legislative Decree No. 21 of 21 February 2014 – "Implementation of Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC and 1999/44/EC and repealing Directives 85/577/EEC and 97/7/EC" – the right of withdrawal is excluded in certain cases, including:
- orders of Products that are liable to deteriorate or expire rapidly;
- orders of Products that are made to measure or clearly personalized;
- orders of sealed Products that are not suitable for return due to health protection or hygiene reasons, and that have been opened after delivery.
With reference to the above exclusions, the Customer is specifically informed and accepts that all food products (including wines, spirits, oils, and beverages) fall under the category of "products liable to deteriorate or expire rapidly."
To protect our Customers and for hygiene reasons, the right of withdrawal only applies to products that can be resold without endangering the health of consumers. For this reason, it is not possible to return food products for which proper storage conditions cannot be guaranteed.
The Customer may exercise the right of withdrawal, pursuant to Articles 52 et seq. of Legislative Decree No. 206/2005, in relation to specific Products other than those listed above, provided that such Products have not been opened or their seals altered after delivery.
In cases where the right of withdrawal is permitted, the Customer has the right to withdraw from the purchase contract for any reason, without having to provide any justification and without incurring any penalties.
To exercise the right of withdrawal, the Customer must send a written notice to Azienda Agricola Carmelo Laudani within 14 days from the date of delivery of the Products. The notice must be sent via email to info@neddu.it, with the subject line “Exercise of Right of Withdrawal”, clearly stating the intention to withdraw from the contract and providing the following additional information:
- order number and date of purchase;
- delivery date of the order;
- Customer’s full name and address;
- Customer’s email address and phone number;
- names of the items for which the right of withdrawal is being exercised.
The right of withdrawal applies to the purchased Product in its entirety. Therefore, if the Product is composed of multiple parts or components, it is not possible to exercise the right of withdrawal only on a portion of the Product.
Upon receiving the withdrawal request, Azienda Agricola Carmelo Laudani will initiate a return process and inform the Customer of the return instructions. The return will be handled via a courier specified by Azienda Agricola Carmelo Laudani.
In the event of a valid withdrawal, Azienda Agricola Carmelo Laudani will refund the Customer the full amount paid for the returned Products within 14 days from receipt of the withdrawal notice. However, the Company reserves the right to withhold the refund until the returned Products are received.
The refund will be processed using the same payment method used by the Customer at the time of purchase.
The Customer also has the right—if applicable and depending on the nature of the Product—to have the Product’s conformity restored at no cost through repair or replacement, or to receive an appropriate price reduction or to terminate the contract.
This right is forfeited if the Customer does not report the lack of conformity to Azienda Agricola Carmelo Laudani by the day following receipt of the Products.
